  • Family law: divorce, custody, child support, protective orders

District Court Cases in Lane

In Oregon, the term "district court" is not used at the state level — all cases are heard by the Circuit Court. Lane County Circuit Court has full jurisdiction over criminal felonies, from indictment or prosecutor information to sentencing and post-trial motions. Civil cases without limitation on the amount of the claim also fall under the jurisdiction of this court.

Cases are distributed among judges according to the internal rules of the court. The Presiding Judge oversees the distribution of workload. Appeals from Circuit Court decisions are filed with the Oregon Court of Appeals. Post-trial proceedings, including motions for sentence review under ORS 138.510–138.680, are also heard in Circuit Court.

Magistrate Court Cases in Lane

Oregon does not have separate magistrate courts at the state level. Instead, the Circuit Court hears cases that in other states would fall under magistrate jurisdiction:

  • Misdemeanors and violations
  • Preliminary hearings in criminal cases
  • Traffic violations, including DUI
  • Small claims — up to $10,000 according to ORS 46.405
  • Civil cases of any amount (Circuit Court has no lower jurisdictional limit)

Small claims are handled through a simplified procedure without mandatory attorney representation. A judge or judge pro tempore conducts the hearing and issues a decision. Traffic cases are often resolved through guilty pleas or attendance at traffic safety programs.

Family Law, Probate, and Juvenile Matters in Lane

Family Law

Cases involving dissolution of marriage, custody, child support, protective orders, establishment of paternity, and termination of parental rights are heard by Lane County Circuit Court. Lane County does not issue divorce records — they are maintained by the Circuit Court Clerk's Office. Certified copies of divorce records can also be ordered through Oregon Vital Records.

Probate

Estate administration, appointment of guardians and conservators, and trust matters fall under the jurisdiction of the Circuit Court. Cases are handled by assigned judges according to internal distribution.

Juvenile Matters

Juvenile matters include proceedings under the Juvenile Justice Act and child protection cases (dependency). Juvenile case records are confidential under Oregon law and are not publicly accessible without a court order. A separate court division coordinates work with juveniles.

How Cases Move Through the Lane Court System

  1. Case Initiation. A criminal case begins with an indictment, prosecutor information, or complaint. A civil case begins with the filing of a complaint or petition with the court clerk's office.
  2. Judge Assignment. The clerk's office assigns the case to a specific judge according to the court's internal rules.
  3. Initial Hearings. In criminal cases, an arraignment is held. In civil cases, a scheduling conference or initial hearing on the schedule is held.
  4. Pre-trial Phase. Parties file motions, conduct discovery. In criminal cases, plea negotiations may occur.
  5. Trial or Settlement. The case concludes with a jury verdict, judge's decision, plea agreement, settlement, or default judgment.
  6. Post-judgment. Criminal cases move to the sentencing stage. Parties may appeal to the Oregon Court of Appeals. In civil cases, enforcement of the judgment occurs.
